1. About this policy
Farm Medix Limited (company number 3180250) (Farm Medix, we, us) respects your privacy. This policy explains what personal information we collect, why, who we share it with, how long we keep it, and what rights you have.
It covers our websites at www.farmmedix.nz, www.farmmedix.com and www.farmmedix.ca, our online store, the Farm Medix platform whether you use it in a browser or through our iOS or Android apps, our laboratory and diagnostic services, and our marketing and events.
Personal information means information about an identified or identifiable individual. It has the same meaning as personal data under the GDPR and personal information under other applicable laws.
If you are in Australia, the United Kingdom, Ireland, the EU, or Canada, section 12 has information specific to your country.
2. A note about farm data
Most of the data in the platform is about animals, herds, samples, and milk, not about people, and that data is generally not personal information.
But if your farm business is a sole trader or a partnership, information about the business is often also information about you as an individual, and we treat it as personal information. Records you enter about your staff or your veterinarian are personal information about them, and where we hold that for you, Schedule 2 of our Terms applies.
3. What we collect

Contact and account information: your name, business or farm name, role, business address, email address, telephone number, and what we use to confirm your business is eligible for an account.

Farm, herd, and animal records: herd, animal, and quarter records, sample records, test results, treatment records including animal remedies used, withholding periods and withhold expiry dates you or your veterinarian enter, milk quality and somatic cell count data, and production data.

Messages: messages between you and Farm Medix through the platform, and your enquiries, support requests, and correspondence with us.

Consents and authorisations: records of the consents and authorisations you give us, including authority to access data held by a laboratory or a herd database on your behalf.

Events and research: information you give us at roadshows, workshops, or webinars, or in surveys, case studies, and testimonials.

Orders, if you buy from us: billing and delivery address, order details, and payment confirmation. Our payment provider processes your card details and we do not store your full card number.

Automatically: pages and screens viewed, features used, dates and times, device type, operating system, browser, app version, IP address, general location inferred from IP address at city or region level, server logs, and error reports. We do not collect precise GPS location.
4. Information we collect from third parties, with your authority
Where you authorise it, we collect data about your farm and herd from third parties so the platform is useful without you re-keying it. Depending on what you connect, these may include laboratories that test your samples, herd databases and herd testing organisations, animal tracing systems, your milk company, your veterinarian, and partner organisations through which you obtained our products.
We access those systems on your instruction and within the authority you give us. You can withdraw an authorisation at any time by contacting us, and we will stop accessing that source, though we will keep data already received in accordance with section 8.

6. Aggregated and de-identified data
We combine data from across our customers to produce aggregated, de-identified datasets. We use these to generate regional and national benchmarks, to research herd health, mastitis, and milk quality, and to improve our products. We may continue to use aggregated data after your account is closed.
Aggregated data does not identify you, your farm, or any individual. We do not publish or share it in a form that could reasonably be used to identify you.
This is what makes the benchmarks in the platform useful: the more farms contribute, the better the comparison each farm gets.
7. Automated analysis
The platform analyses your data to produce scores, indicators, alerts, and recommendations, such as chronicity indicators and herd health metrics. These support decisions made by you and your veterinarian. They are not decisions about you as an individual, and we do not make decisions producing legal or similarly significant effects concerning you based solely on automated processing.
Results and recommendations in the platform are decision support and are not a veterinary diagnosis or advice. See clause 12 of our Terms.
8. Who we share information with

People you direct us to share with: your veterinarian, advisers, staff, or a partner organisation, where you enable sharing or send a message.

Laboratories and data sources you authorise: to send and receive the data you asked us to connect.

Partner organisations: where you obtained our products through a partner, or where you have asked us to work with them on your account.

Our software development partner: we developed and maintain the platform with a software development partner who has access to our systems under written confidentiality and data protection obligations, and only as necessary to build and support the platform.

Service providers: cloud hosting, website and store hosting, email delivery, and payment processing. They act on our instructions and may only use the information to provide services to us.

Advertising partners on our website: our marketing website uses a Meta pixel, which shares information about your visit with Meta. This does not apply to the platform. See section 11.

Professional advisers and authorities: lawyers, accountants, and insurers under confidentiality obligations, and authorities where required by law or to establish or defend legal claims.

A purchaser: if we sell or reorganise our business, under confidentiality obligations and subject to this policy continuing to apply.
We do not sell your personal information. You can ask us at info@farmmedix.com for a current list of the service providers who process personal information for us.
9. Sending information overseas
We are based in New Zealand. The platform is hosted in Australia. Our website and store run on Shopify, and our website uses a Meta pixel, so information about visits to our website is processed by those companies in the countries where they operate.
New Zealand has been recognised by the European Commission as providing an adequate level of protection for personal data, and is recognised for transfers from the United Kingdom. Where we transfer information to a country without an adequacy decision, we use appropriate safeguards, including the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum.
10. Security and retention
We protect personal information with measures appropriate to the risk. Connections are encrypted in transit, access to production systems is limited to the people who need it and is removed when they no longer need it, the platform is hosted with a reputable cloud provider in Australia, we take regular backups, everyone with access is bound by written confidentiality obligations, and we have a process for identifying and responding to security incidents.
No system is completely secure. We cannot guarantee the security of information you send us over the internet. If a breach occurs that is likely to cause serious harm, we will notify affected people and the relevant regulator as the law requires.
How long we keep information:

Account, farm, herd, and test records: while your account is open, and for up to 12 months after it closes.

Laboratory records: 7 years, to meet accreditation and traceability obligations.

Order and financial records: 7 years, to meet tax and company law obligations.

Aggregated de-identified data: indefinitely. It no longer identifies anyone.

Marketing opt-outs: indefinitely, so we do not contact you again.
We may keep information for longer where the law requires it or where it is needed for a legal claim.
11. Cookies and tracking
Our marketing website and store run on Shopify and use cookies. Shopify describes the cookies it sets at www.shopify.com/legal/cookies. Our website also uses a Meta pixel, which is a marketing cookie that helps us measure our advertising and shares information about your visit with Meta.
If you are in the United Kingdom, Ireland, or the EU, we ask for your consent before setting any cookie that is not strictly necessary, and you can change or withdraw your choice at any time using the cookie settings on our website. If you are elsewhere, you can control cookies through your browser settings.
The Farm Medix platform uses only the cookies it needs to sign you in and keep your session secure. It does not use advertising cookies and does not track you across other websites. Blocking these cookies will prevent you from signing in.
Our iOS and Android apps do not use cookies. They store a session identifier to keep you signed in, and a token to deliver notifications if you turn them on. They do not track you across other companies' apps or websites.
12. Your rights
Depending on where you are, you may have some or all of these rights. Some are not absolute and we may decline a request where the law permits, giving reasons.
Access, to ask for a copy of the personal information we hold about you. Correction, to ask us to fix information that is wrong or incomplete. Deletion, to ask us to delete information where the law gives you that right. Portability, to ask for a copy in a commonly used, machine readable format. Restriction, to ask us to limit how we use information in certain circumstances. Objection, to object to processing based on legitimate interests, or to direct marketing at any time. Withdrawal of consent, where we rely on consent. And the right to complain, to us and to your regulator.
To exercise any of these, email info@farmmedix.com. We will respond within 20 working days. We may need to verify your identity first. You may use an authorised agent, and we will ask for proof of their authority. We will not treat you differently for exercising a right.
You can also generate and download reports from the platform at any time while your account is open.
13. Marketing
We send newsletters, product news, and event invitations where you have consented or where the law otherwise permits. Every message has an unsubscribe link and you can change your preferences at any time. If you opt out of marketing, we will still send you notices about your account and the service, as described in clause 19.6 of our Terms.
14. Children
The platform is for farming and veterinary businesses and is not directed at children. We do not knowingly collect personal information from children. If you believe a child has given us personal information, contact us and we will delete it.
15. Country-specific information

New Zealand. We handle personal information under the Privacy Act 2020 and the Information Privacy Principles. You may complain to us and, if unresolved, to the Office of the Privacy Commissioner at privacy.org.nz.

Australia. We handle personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You may deal with us anonymously or under a pseudonym where practicable, though we generally cannot provide the platform without knowing who you are. Personal information is stored in Australia and disclosed to us in New Zealand, and we take reasonable steps to ensure overseas recipients handle it consistently with the Australian Privacy Principles. You may complain to us and, if unresolved, to the Office of the Australian Information Commissioner at oaic.gov.au.

United Kingdom, Ireland, and the EU. Our legal bases are in the table in section 5. Where we act as a processor for a customer, Schedule 2 of our Terms applies. You may complain to the Information Commissioner's Office in the UK, the Data Protection Commission in Ireland, or the supervisory authority in your Member State.

Canada. We handle personal information under PIPEDA and, where applicable, the Alberta and British Columbia Personal Information Protection Acts. We rely on your consent, express or implied as the law permits, and you may withdraw it on reasonable notice. Personal information is stored in Australia and disclosed to us in New Zealand, and may be accessible to the courts and authorities of those countries. The platform is not currently offered to users established in Quebec. You may complain to the Office of the Privacy Commissioner of Canada.

We may update this policy. We will post the updated version here and change the last updated date. For material changes we will give notice by email or in the platform before the change takes effect, and will obtain your consent where the law requires it. We keep a record of previous versions and will provide a copy on request.
